Resident Lawsuit Challenges El Portal Apartment Project Featured in The Real Deal

Another major publication has spotlighted the legal battle unfolding in El Portal. In The Real Deal‘s latest coverage, attorney Raul Gastesi of Gastesi Lopez Mestre & Cobiella represents homeowner Jerilyn Kobrick in her lawsuit against the Village of El Portal and Barrington Brothers over an eight-story, 152-unit development.

The article, titled “Homeowner fires legal torpedo at Barrington Brothers’ latest El Portal project,” details how the project—The Launch at Little River—was approved despite zoning regulations that limit building height to four stories when within 250 feet of a residential home. Ms. Kobrick’s property is just 171 feet away.

Speaking to The Real Deal, Gastesi said:

“This project is just a bad idea any way you look at it. Especially for my client. She’s entitled to not have an eight-story building within 250 feet of her property. [Village officials] just didn’t care.”
He closed the article with a clear message:
“This is a residential neighborhood, and [the developer is] shoving an eight-story building into the middle of it.”

The lawsuit seeks to halt construction and reverse the village’s approvals. You can view the full article here (subscription may be required).
